Disclaimer and limitation of liability

Last updated: 26 October 2026

Please read this page before you use GenkiCars - Let the car dealer contact you. By sending a request, creating an account or registering as a dealer, you accept it, together with our Terms of service and Privacy policy. Dealers also accept our Dealer agreement.

1. What GenkiCars - Let the car dealer contact you does

GenkiCars - Let the car dealer contact you is an introduction service. Buyers describe the car they are looking for. Car dealers in Japan that we have checked can see the request, without the buyer's name or contact details, and write to the buyer through GenkiCars - Let the car dealer contact you. After that, the buyer and the dealer deal with each other directly.

GenkiCars - Let the car dealer contact you is not a party to any sale. We do not:

  • own, sell, buy, rent or lend any vehicle;
  • inspect, test, repair, value or certify any vehicle;
  • take, hold or pass on any payment for a vehicle;
  • transport, ship, export, import, register or insure any vehicle;
  • prepare or check the documents of a sale (such as the vehicle inspection certificate, 車検証);
  • give legal, tax, customs, insurance or mechanical advice.

2. What "verified dealer" means

Before a dealer can write to buyers, we check the company's registration with Japan's National Tax Agency, its secondhand dealer licence, its registered address and that it has a bank account in the company name, and we hold a video call with a named manager. These checks are made at the time we approve the dealer, from the documents and information the dealer gives us.

They show that the dealer is a real, licensed business. They are not a guarantee of a particular car, of its price or condition, or of how the dealer will behave in a sale. If something goes wrong with a dealer, please tell us: we review reports and can remove a dealer from GenkiCars - Let the car dealer contact you.

3. The car and the sale are between you and the dealer

The dealer who sells you a car is the seller. The dealer alone is responsible for the car, its description, condition, roadworthiness and inspection (車検), its paperwork, its delivery and any warranty it gives. Any contract of sale is between you and the dealer, and your rights under Japanese law are rights against the dealer (and, for a defect in the car itself, against its manufacturer). GenkiCars - Let the car dealer contact you takes no part in it.

Before you pay, we strongly recommend that you:

  • see the car in person, or have it checked by an independent inspector you choose;
  • check its vehicle inspection certificate (車検証), its inspection date and its service history;
  • get the price, what is included and any warranty in writing from the dealer;
  • pay only into a bank account in the dealer's company name, never to a person and never to GenkiCars - Let the car dealer contact you;
  • if you live outside Japan, check with your own country's authorities whether the car can be imported and registered there (including right-hand drive rules), and what duties and taxes apply.

4. Driving, accidents, injury and death

Once you have bought a car, you are its owner and you decide how, where and by whom it is driven. GenkiCars - Let the car dealer contact you never owns, drives, operates, maintains or controls any vehicle, and has no way to.

Under Japanese law, the person who operates a car for their own use is responsible for personal injury or death caused by its operation (Act on Securing Compensation for Automobile Accidents, Article 3), and every car on the road must carry compulsory liability insurance (自賠責保険). A defect in the car itself is a matter for its manufacturer (Product Liability Act) or its seller. GenkiCars - Let the car dealer contact you is none of these.

For that reason, GenkiCars - Let the car dealer contact you is not responsible for any accident, injury, death, illness, damage to property or other loss that arises from a vehicle you bought from a dealer you met through GenkiCars - Let the car dealer contact you: from its condition, a defect, its repair or modification, its transport, import or registration, or from the way it is driven or used. This applies except as set out in section 7.

Before driving, make sure that the car has a valid inspection (車検), that compulsory insurance and, we strongly recommend, voluntary insurance (任意保険) are in place, and that the driver holds a licence valid in Japan or in the country where the car is used.

5. Information on the site

Messages, offers, prices, photos and descriptions sent by dealers are the dealer's own, and the dealer is responsible for them. Country guides, right-hand drive information and other general information on GenkiCars - Let the car dealer contact you are for guidance only and may change: always check with the official authority before you act on them. Links to other websites are given for convenience; we do not control those sites.

6. Availability of the service

We work to keep GenkiCars - Let the car dealer contact you available and secure, but we cannot promise that it will always be online or free of errors, that any request will receive an answer, or that any dealer will have a suitable car. We may change, pause or end any part of the service.

7. Our liability

Nothing on this page, in our Terms of service or anywhere else on GenkiCars - Let the car dealer contact you excludes or limits our liability:

  • for damage caused by our intent or gross negligence (or that of our representatives or staff); or
  • in any other case where Japanese law, including the Consumer Contract Act, does not allow it to be excluded or limited.

Only where we are liable for slight negligence (that is, negligence that is not gross negligence) towards a buyer, our liability is limited to the direct and ordinary damage that the buyer actually suffered as a result. This limit applies only to slight negligence on our part.

For dealers, who use GenkiCars - Let the car dealer contact you as a business, and again only in the case of our slight negligence, our total liability is limited to the amount the dealer paid us in the three months before the event that caused the damage.

8. Law and courts

This page, our Terms of service and the use of GenkiCars - Let the car dealer contact you are governed by the laws of Japan. Any dispute will be heard by the courts of Japan that have jurisdiction under Japanese law. Nothing here takes away rights that the law of your own country gives you as a consumer and that cannot be waived.

9. Changes and contact
