Dealer agreement

Last updated: 3 November 2026

1. The parties and this agreement

GenkiCars - Let the car dealer contact you is run by Genki Group Japan (ゲンキ グループ ジャパン), 愛知県 名古屋市 天白区平針 1丁目 1-chōme−1206 Tempaku Ku (contact: [email protected]).

This agreement is between GenkiCars - Let the car dealer contact you and the company that registers as a dealer ("you"). The person who registers confirms that they are allowed to accept it for the company. You accept it by ticking the box when you register. Our Disclaimer, our Privacy policy and the parts of our Terms of service that apply to every user are part of it.

2. What GenkiCars - Let the car dealer contact you provides

GenkiCars - Let the car dealer contact you shows car requests from buyers in Japan and abroad on a request board, sends you alerts about requests that fit your area or export countries, and lets you write to a buyer with a credit. We introduce buyers to you. We do not take part in any sale, and we do not promise any number of requests, replies or sales.

3. Registration and checks

  • Everything you give us must be true and complete: company name, corporate number, secondhand dealer licence (古物商許可) number, address, contact person and contact details.
  • Before you can write to any buyer, we check your company: its registration with the National Tax Agency, its secondhand dealer licence, its registered address, a bank account in the company name, and a short video call with a named manager. You must also confirm your email address.
  • Tell us within 14 days if any of this changes, and at once if your licence is suspended or cancelled.
  • We may check again at any time, and we may refuse a registration without giving a reason.

4. Licences and the law

You hold every licence your business needs and you follow every law that applies to it. This includes the Secondhand Articles Dealer Act, the Road Transport Vehicle Act, the Act against Unjustifiable Premiums and Misleading Representations, the Consumer Contract Act, the Act on the Protection of Personal Information, and, for exports, the Foreign Exchange and Foreign Trade Act, customs rules and the rules of the destination country.

5. The cars you offer

For every car you offer to a buyer you meet through GenkiCars - Let the car dealer contact you, you promise that:

  • you have the legal right to sell it;
  • your description is true and complete, including its accident and repair history (修復歴), its real mileage, its inspection (車検) status and any open recall;
  • it has not had its odometer changed, and it is not stolen or under a loan or lien you have not disclosed;
  • if it is sold to be driven on the road, it is safe and meets the legal standards when you hand it over. A car that does not (for example a car sold without a valid inspection, or for parts) must be described that way in writing before the sale;
  • you give the buyer the price, what it includes and any warranty in writing.

6. You are the seller

  • Every sale is between you and the buyer. You alone are responsible for the contract, the car, its documents, its delivery, its registration or export, and any warranty.
  • Buyers pay you only into a bank account in your company name. You never ask a buyer to pay a person, or to pay GenkiCars - Let the car dealer contact you.
  • You do not say or suggest that GenkiCars - Let the car dealer contact you has inspected, recommended, valued or guaranteed a car, or that it guarantees your sale. You may say that your company was checked by GenkiCars - Let the car dealer contact you, and nothing more.

7. Buyers' information

  • You use what a buyer tells you, and their contact details if they reply to you, only to answer that buyer about their request.
  • You do not add buyers to mailing lists, send them advertising they did not ask for, or give, sell or show their information to anyone else.
  • You handle it under the Act on the Protection of Personal Information as your own responsibility, keep it safe, and delete it when you no longer need it for the sale.
  • If a buyer says no, or does not answer, you stop writing to them.

8. Your messages

Your messages are about the buyer's request, true, polite and in your company's name. They do not contain links to other sites made to collect information or payments, or anything unlawful. We may read messages sent through GenkiCars - Let the car dealer contact you to prevent fraud and to handle reports, and we may refuse to deliver a message that breaks this agreement. A refused message does not use a credit.

Two days after you write to a buyer, we ask the buyer to rate you from 1 to 5 stars, with a link that works once. Your average score is shown to you and, once you have 3 ratings, to the buyers you write to. We may use low scores and buyer reports when we review your account (section 12).

9. Credits

  • One credit lets you read one request in full and send that buyer one message.
  • Credits come in packs, at the price shown on the credit page when you order. You pay by card on our payment page; the payment is processed by Stripe, and the credits are added as soon as it is confirmed. A Custom pack is paid by bank transfer against our invoice, and its credits are added when it is paid.
  • Credit packs can be bought only once we have approved your company. When we approve it, we add 3 free credits to your account, once per company, so you can try GenkiCars - Let the car dealer contact you. They last 30 days from that day. They work like other credits, but they do not earn the bonus and cannot be exchanged for money.
  • You can also take a pack every month (a monthly plan), at the monthly price shown on the credit page when you start it. Your card is charged on the day you start and then on the same date each month, and the pack's credits are added after each payment. You can stop the plan at any time on the credit page: it ends at the end of the month you have paid for, the credits you have stay until they expire, and the month already paid is not refunded. If a monthly payment fails, Stripe tries again for a few days; if it still fails, the plan stops.
  • Credits last 30 days from the day they are added. The credits that expire soonest are used first. Credits that are not used in time end. Credits cannot be exchanged for money.
  • If you use a whole pack before it ends, you receive 3 free credits, once per pack.
  • A credit is used when your message is sent, whether or not the buyer replies or buys. If a credit is used because of a fault on our side, we give it back.
  • We may change pack prices for future orders. A change never affects credits you have already paid for.

10. Your responsibility to GenkiCars - Let the car dealer contact you

If a buyer or anyone else makes a claim against GenkiCars - Let the car dealer contact you because of a car you offered or sold, your description of it, your sale, or your breach of this agreement or of the law, you will cover the damage this causes to GenkiCars - Let the car dealer contact you, including reasonable lawyer's fees. We tell you about such a claim promptly and give you the information we have about it.

11. Our responsibility to you

We are not responsible for lost sales or profits, or for what a buyer does. If we cause you damage through slight negligence, our total liability is limited to the amount you paid us in the three months before the event that caused it. This limit does not apply to damage caused by our intent or gross negligence.

12. Suspension and ending

  • You can close your dealer account at any time by writing to [email protected].
  • We may suspend your account or end this agreement if you break it, if we receive credible reports about your company, if your licence or registration is no longer valid, or if the law requires it. Credits are not refunded when an account is closed for a breach.
  • If we close your account for any other reason, or end the service, we refund the price of the paid credits you had not used yet.

13. No anti-social forces

You confirm that your company, its officers and its main shareholders are not, and have no relationship with, organised crime groups (暴力団), their members or other anti-social forces, and will not become so. If this is not true, we may end this agreement at once, without notice and without any compensation.

14. Confidentiality

Anything we tell you that is not public (for example about other dealers or about how GenkiCars - Let the car dealer contact you works) stays confidential. The same applies to us for the non-public information you give us during the checks, except where the law requires us to share it.

15. Changes to this agreement

We may change this agreement. We email you and publish the new version on this page at least 14 days before it applies. We then ask you to accept the new version the next time you sign in, and your account cannot write to buyers until you do.

16. Law and courts

This agreement is governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction over any dispute in the first instance. If a version of this agreement in another language differs from the English one, the English one applies.

17. Contact

Questions about this agreement: [email protected].
